de uso (Termos) regem seu acesso e uso como pessoa f\u00edsica, dentro e fora do Brasil, de aplicativos, s\u00edtios de Internet, conte\u00fados, bens e tamb\u00e9m servi\u00e7os (os Servi\u00e7os) disponibilizados pela EMERGIT SOLU\u00c7\u00d5ES EM IOT LTDA., sociedade de responsabilidade limitada, estabelecida no Brasil com sede na <u><a href=\"https:\/\/www.google.com\/maps\/search\/Avenida+Carlos+Gomes,+n%C2%BA+1000,+sala+301,+CEP+90480-001,+Porto+Alegre%2FRS?entry=gmail&amp;source=g\" target=\"_blank\" rel=\"noopener\">Avenida Carlos Gomes, n\u00ba 1000, sala 301, CEP 90480-001, Porto Alegre\/RS<\/a><\/u> inscrita no Cadastro Nacional de Pessoas Jur\u00eddicas do Minist\u00e9rio da Fazenda (CNPJ\/MF) sob n. 29.017.576\/0001-43 denominado neste termo pelo nome do servi\u00e7o oferecido (Moodr).<\/p>\n<p>\u00a0<\/p>\n<p>POR FAVOR, LEIA COM ATEN\u00c7\u00c3O ESTES TERMOS ANTES DE ACESSAR OU USAR OS SERVI\u00c7OS.<\/p>\n<p>\u00a0<\/p>\n<p>Ao acessar e usar os Servi\u00e7os voc\u00ea concorda com os presentes termos e condi\u00e7\u00f5es, que estabelecem o relacionamento contratual entre voc\u00ea e a (Moodr). <strong>Se voc\u00ea n\u00e3o concorda com estes Termos, voc\u00ea n\u00e3o pode acessar nem usar os Servi\u00e7os.<\/strong> Mediante referido acesso e uso, estes Termos imediatamente substituem e superam todos os Termos e acordos anteriores entre voc\u00ea e o servi\u00e7o (Moodr). A (Moodr) poder\u00e1 imediatamente encerrar estes Termos ou quaisquer Servi\u00e7os em rela\u00e7\u00e3o a voc\u00ea ou, de modo geral, deixar de oferecer ou negar acesso aos Servi\u00e7os ou a qualquer parte deles, a qualquer momento e por qualquer motivo.<\/p>\n<p>\u00a0<\/p>\n<p>Termos adicionais poder\u00e3o se aplicar a determinados Servi\u00e7os, tais como condi\u00e7\u00f5es para um evento, atividade ou promo\u00e7\u00e3o em particular, e esses Termos adicionais ser\u00e3o divulgados em rela\u00e7\u00e3o aos respectivos Servi\u00e7os. Termos adicionais s\u00e3o complementares e considerados parte integrante deste Termo de Condi\u00e7\u00f5es e Privacidade para os efeitos dos respectivos Servi\u00e7os. Termos adicionais prevalecer\u00e3o sobre estes Termos em caso de conflito com rela\u00e7\u00e3o aos referidos Servi\u00e7os.<\/p>\n<p>\u00a0<\/p>\n<p>A (Moodr) poder\u00e1 alterar os Termos relativos aos Servi\u00e7os a qualquer momento. Aditamentos entrar\u00e3o em vigor quando a (Moodr) fizer a postagem da vers\u00e3o atualizada dos Termos neste local ou das condi\u00e7\u00f5es atualizadas ou Termos adicionais sobre o respectivo Servi\u00e7o. O fato de voc\u00ea continuar a acessar ou usar os Servi\u00e7os ap\u00f3s essa postagem representa seu consentimento em vincular-se aos Termos alterados.<\/p>\n<p>\u00a0<\/p>\n<p>Ao aceitar estes Termos voc\u00ea assume a responsabilidade pelo uso dos Servi\u00e7os e resultados decorrentes deste.<\/p>\n<p>\u00a0<\/p>\n<ol start=\"2\">\n<li>OS SERVI\u00c7OS<\/li>\n<\/ol>\n<p>\u00a0<\/p>\n<p>Os Servi\u00e7os integram uma plataforma de tecnologia que permite aos(\u00e0s) Usu\u00e1rios(as) de aplicativos m\u00f3veis ou s\u00edtios de Internet da (Moodr), fornecidos como parte dos Servi\u00e7os (cada qual um Aplicativo), auxiliar no servi\u00e7o de acompanhamento de tratamentos psiqui\u00e1tricos. A menos que diversamente acordado pela (Moodr) em contrato escrito em separado firmado com voc\u00ea, o Servi\u00e7o ser\u00e1 disponibilizado para seu<strong> uso pessoal e n\u00e3o comercial.<\/strong><\/p>\n<p>\u00a0<\/p>\n<p>Voc\u00ea compreende e aceita que <strong>este servi\u00e7o n\u00e3o prov\u00ea orienta\u00e7\u00e3o m\u00e9dica<\/strong>. Os servi\u00e7os que s\u00e3o executados por este aplicativo s\u00e3o de uso sob acompanhamento m\u00e9dico, desta forma, voc\u00ea concorda que este aplicativo n\u00e3o prov\u00ea nenhuma recomenda\u00e7\u00e3o m\u00e9dica. <strong>O uso dos servi\u00e7os n\u00e3o substitui outros tratamentos de sa\u00fade.<\/strong> Se voc\u00ea estiver numa situa\u00e7\u00e3o de emerg\u00eancia ou risco \u00e0 vida, procure assist\u00eancia m\u00e9dica imediatamente.<\/p>\n<p>\u00a0<\/p>\n<p>Ressalta-se que este \u00e9 um aplicativo de uso m\u00e9dico, n\u00e3o recreativo. Logo, o aplicativo n\u00e3o substitui o m\u00e9dico que o prescreveu e que estar\u00e1 sempre assistindo o caso, inclusive em casos de comportamento suicida. ESTE APLICATIVO N\u00c3O FOI DESENVOLVIDO PARA SUBSTITUIR O\/A PSIQUIATRA EM CASOS GRAVES COM RISCO DE SUIC\u00cdDIO. N\u00e3o foi desenvolvido para ser um substituto do m\u00e9dico EM URG\u00caNCIAS M\u00c9DICAS ou para PREVENIR SUIC\u00cdDIOS, e sim como um assistente do cuidado habitual em sa\u00fade mental. Ou seja, cabe ao cl\u00ednico que o prescreveu e n\u00e3o ao aplicativo orientar o paciente sobre a\u00e7\u00f5es em caso do surgimento de qualquer idea\u00e7\u00e3o suicida grave. Cabe ao usu\u00e1rio buscar seu m\u00e9dico assistente e seguir suas orienta\u00e7\u00f5es sobre situa\u00e7\u00f5es de piora. De qualquer forma, o aplicativo conta com mensura\u00e7\u00e3o de idea\u00e7\u00e3o suicida no seu desenho, para acompanhamento do cl\u00ednico, mas <strong>n\u00e3o para ser sua substitui\u00e7\u00e3o em casos de urg\u00eancia<\/strong>, em que recomendamos que se utilizem os modos habituais de manejo destas situa\u00e7\u00f5es JUNTO AO\/\u00c0 M\u00c9DICO\/A. O Moodr n\u00e3o substitui o\/a m\u00e9dico\/a que est\u00e1 conduzindo seu caso.<\/p>\n<p>\u00a0<\/p>\n<p>LICEN\u00c7A,<\/p>\n<p>Sujeito ao cumprimento destes Termos, a (Moodr) outorga a voc\u00ea uma licen\u00e7a limitada, n\u00e3o exclusiva, n\u00e3o pass\u00edvel de sublicen\u00e7a, revog\u00e1vel e n\u00e3o transfer\u00edvel para: (i) acesso e uso dos Aplicativos em seu dispositivo pessoal, exclusivamente para o seu uso dos Servi\u00e7os; e (ii) acesso e uso de qualquer conte\u00fado, informa\u00e7\u00e3o e material correlato que possa ser disponibilizado por meio dos Servi\u00e7os, em cada caso, para seu uso pessoal, nunca comercial. Quaisquer direitos n\u00e3o expressamente outorgados por estes Termos s\u00e3o reservados \u00e0 (Moodr) e suas afiliadas.<\/p>\n<p>\u00a0<\/p>\n<p>RESTRI\u00c7\u00d5ES,<\/p>\n<p>Voc\u00ea n\u00e3o poder\u00e1: (i) remover qualquer aviso de direito autoral, direito de marca ou outro aviso de direito de propriedade de qualquer parte dos Servi\u00e7os; (ii) reproduzir, modificar, preparar obras derivadas, distribuir, licenciar, locar, vender, revender, transferir, exibir, veicular, transmitir ou, de qualquer outro modo, explorar os Servi\u00e7os, exceto da forma expressamente permitida pela (Moodr); (iii) decompilar, realizar engenharia reversa ou desmontar os Servi\u00e7os, exceto conforme permitido pela legisla\u00e7\u00e3o aplic\u00e1vel; (iv) conectar, espelhar ou recortar qualquer parte dos Servi\u00e7os; (v) fazer ou lan\u00e7ar quaisquer programas ou scripts com a finalidade de fazer scraping, indexa\u00e7\u00e3o, pesquisa ou qualquer outra forma de obten\u00e7\u00e3o de dados de qualquer parte dos Servi\u00e7os, ou de sobrecarregar ou prejudicar indevidamente a opera\u00e7\u00e3o e\/ou funcionalidade de qualquer aspecto dos Servi\u00e7os; ou (vi) tentar obter acesso n\u00e3o autorizado aos Servi\u00e7os ou prejudicar qualquer aspecto dos Servi\u00e7os ou seus sistemas ou redes correlatas.<\/p>\n<p>\u00a0<\/p>\n<p>SERVI\u00c7OS E CONTE\u00daDO DE TERCEIROS(AS),<\/p>\n<p>Os Servi\u00e7os poder\u00e3o ser disponibilizados e acessados em conex\u00e3o com Servi\u00e7os e conte\u00fado de terceiros(as) (inclusive publicidade) que a (Moodr) n\u00e3o controlar\u00e1. VOC\u00ca RECONHECE QUE TERMOS DE USO E POL\u00cdTICAS DE PRIVACIDADE DIFERENTES PODER\u00c3O SER APLIC\u00c1VEIS AO USO DESSES SERVI\u00c7OS E CONTE\u00daDO DE TERCEIROS(AS). A (MOODR) N\u00c3O ENDOSSA ESSES SERVI\u00c7OS E CONTE\u00daDO DE TERCEIROS(AS) E A (MOODR) N\u00c3O SER\u00c1, EM HIP\u00d3TESE ALGUMA, RESPONS\u00c1VEL POR NENHUM PRODUTO OU SERVI\u00c7O DESSES(AS) TERCEIROS(AS) FORNECEDORES(AS). Al\u00e9m disto, Apple Inc., Google, Inc., e\/ou suas subsidi\u00e1rias e afiliadas internacionais ser\u00e3o terceiros(as) benefici\u00e1rios(as) deste Contrato, caso voc\u00ea acesse os Servi\u00e7os usando aplicativos desenvolvidos para dispositivos m\u00f3veis baseados em Apple iOS e Android, respectivamente. Esses(as) terceiros(as) benefici\u00e1rios(as) n\u00e3o s\u00e3o partes deste Contrato e n\u00e3o s\u00e3o respons\u00e1veis pela presta\u00e7\u00e3o dos Servi\u00e7os ou por qualquer forma de suporte aos Servi\u00e7os. Seu acesso aos Servi\u00e7os usando esses dispositivos est\u00e1 sujeito \u00e0s condi\u00e7\u00f5es estabelecidas nos termos de servi\u00e7os dos respectivos terceiros(as) benefici\u00e1rios(as).,<\/p>\n<p>\u00a0<\/p>\n<p>TITULARIDADE,<\/p>\n<p>Os Servi\u00e7os e todos os direitos sobre eles s\u00e3o e permanecer\u00e3o de propriedade da (Moodr), ou de suas respectivas licenciadoras, conforme o caso. Estes Termos e o uso dos Servi\u00e7os n\u00e3o lhe outorgam nem lhe conferem qualquer direito: (i) sobre os Servi\u00e7os, exceto pela licen\u00e7a limitada concedida acima; ou (ii) de usar ou, de qualquer modo, fazer refer\u00eancia a nomes societ\u00e1rios, logotipos, nomes de produtos ou de Servi\u00e7os, marcas comerciais ou marcas de servi\u00e7o da (Moodr) ou de qualquer licenciadora da (Moodr).,<\/p>\n<p>\u00a0<\/p>\n<ol start=\"3\">\n<li>O USO DOS SERVI\u00c7OS<\/li>\n<\/ol>\n<p>\u00a0<\/p>\n<p>CONTAS DE USU\u00c1RIOS,<\/p>\n<p>Para utilizar grande parte dos Servi\u00e7os, voc\u00ea deve registrar-se e manter uma conta pessoal de usu\u00e1rio de Servi\u00e7os (Conta). Voc\u00ea deve ter pelo menos 18 anos ou a maioridade exigida por lei em seu foro (se for diferente de 18 anos) para abrir uma Conta. Registro de Conta exige que voc\u00ea apresente \u00e0 (Moodr) certas informa\u00e7\u00f5es pessoais, tais como seu nome, endere\u00e7o de e-mail, data de nascimento, g\u00eanero e peso. Voc\u00ea concorda em manter informa\u00e7\u00f5es corretas, completas e atualizadas em sua Conta. Voc\u00ea \u00e9 respons\u00e1vel por todas as atividades realizadas na sua Conta e concorda em manter sempre a seguran\u00e7a e o sigilo do nome de usu\u00e1rio e senha da sua Conta. A menos que diversamente permitido pela (Moodr) por escrito, voc\u00ea poder\u00e1 manter apenas uma Conta.<\/p>\n<p>\u00a0<\/p>\n<p>MENSAGENS PROMOCIONAIS,<\/p>\n<p>Ao criar uma Conta, voc\u00ea concorda que os Servi\u00e7os poder\u00e3o lhe enviar mensagens de textos informativas (Notifica\u00e7\u00f5es no Celular) e\/ou mensagens eletr\u00f4nicas (e-mail) como parte das opera\u00e7\u00f5es comerciais regulares para o uso dos Servi\u00e7os. Voc\u00ea poder\u00e1 optar por n\u00e3o receber mensagens de texto e\/ou mensagem eletr\u00f4nica (e-mail) da (Moodr) a qualquer momento enviando e-mail para<strong> atendimento@moodr.com.br<\/strong> e indicando que n\u00e3o mais deseja receber essas mensagens, juntamente com o n\u00famero do telefone celular que as recebe e e-mail. Voc\u00ea reconhece que ao optar por n\u00e3o receber as mensagens poder\u00e1 impactar o uso dos Servi\u00e7os.<\/p>\n<p>\u00a0<\/p>\n<p>ACESSO \u00c0 REDE E EQUIPAMENTOS,<\/p>\n<p>Voc\u00ea \u00e9 respons\u00e1vel por obter o acesso a rede de dados necess\u00e1rio para usar os Servi\u00e7os. As taxas e encargos de sua rede de dados e mensagens poder\u00e3o se aplicar se voc\u00ea acessar ou usar os Servi\u00e7os de um dispositivo sem fio e voc\u00ea ser\u00e1 respons\u00e1vel por essas taxas e encargos. Voc\u00ea \u00e9 respons\u00e1vel por adquirir e atualizar os equipamentos e dispositivos necess\u00e1rios para acessar e usar os Servi\u00e7os e Aplicativos e quaisquer de suas atualiza\u00e7\u00f5es. A (MOODR) N\u00c3O GARANTE QUE OS SERVI\u00c7OS, OU QUALQUER PARTE DELES, FUNCIONAR\u00c3O EM QUALQUER EQUIPAMENTO OU DISPOSITIVO EM PARTICULAR. Al\u00e9m disso, os Servi\u00e7os poder\u00e3o estar sujeitos a mau funcionamento e atrasos inerentes ao uso da Internet e de comunica\u00e7\u00f5es eletr\u00f4nicas,<\/p>\n<p>\u00a0<\/p>\n<ol start=\"4\">\n<li>LIMITA\u00c7\u00c3O DE RESPONSABILIDADE<\/li>\n<\/ol>\n<p>\u00a0<\/p>\n<p>LIMITA\u00c7\u00c3O DE RESPONSABILIDADE,<\/p>\n<p>A (MOODR) N\u00c3O SER\u00c1 RESPONS\u00c1VEL POR DANOS INDIRETOS, INCIDENTAIS, ESPECIAIS, PUNITIVOS OU EMERGENTES, INCLUSIVE LUCROS CESSANTES, PERDA DE DADOS, DANOS MORAIS OU PATRIMONIAIS RELACIONADOS, ASSOCIADOS OU DECORRENTES DE QUALQUER USO DOS SERVI\u00c7OS AINDA QUE A (MOODR) TENHA SIDO ALERTADA PARA A POSSIBILIDADE DESSES DANOS. A (MOODR) N\u00c3O SER\u00c1 RESPONS\u00c1VEL POR NENHUM DANO, OBRIGA\u00c7\u00c3O OU PREJU\u00cdZO DECORRENTE DO: (i) SEU USO DOS SERVI\u00c7OS OU SUA INCAPACIDADE DE ACESSAR OU USAR OS SERVI\u00c7OS; OU (ii) QUALQUER OPERA\u00c7\u00c3O, AINDA QUE A (MOODR) TENHA SIDO ALERTADA PARA A POSSIBILIDADE DESSES DANOS.<\/p>\n<p>\u00a0<\/p>\n<p>AS LIMITA\u00c7\u00d5ES E RECUSA DE GARANTIAS CONTIDAS NESTA CL\u00c1USULA N\u00c3O POSSUEM O OBJETIVO DE LIMITAR RESPONSABILIDADES OU ALTERAR DIREITOS DE CONSUMIDOR QUE DE ACORDO COM A LEI APLIC\u00c1VEL N\u00c3O PODEM SER LIMITADOS OU ALTERADOS.<\/p>\n<p>\u00a0<\/p>\n<p>INDENIZA\u00c7\u00c3O,<\/p>\n<p>Voc\u00ea concorda em indenizar e manter a (Moodr), seus diretores(as), conselheiros(as), empregados(as) e agentes isentos(as) de responsabilidade por todas e quaisquer reclama\u00e7\u00f5es, cobran\u00e7as, preju\u00edzos, responsabilidades e despesas (inclusive honor\u00e1rios advocat\u00edcios) decorrentes ou relacionados: (i) ao uso dos Servi\u00e7os, de servi\u00e7os ou bens obtidos por meio do uso dos Servi\u00e7os; (ii) descumprimento ou viola\u00e7\u00e3o de qualquer disposi\u00e7\u00e3o destes Termos; (iii) o uso, pela (Moodr), do Conte\u00fado de Usu\u00e1rio(a); ou (iv) viola\u00e7\u00e3o dos direitos de terceiros, inclusive Prestadores Terceiros.<\/p>\n<p>\u00a0<\/p>\n<ol start=\"5\">\n<li>LEGISLA\u00c7\u00c3O APLIC\u00c1VEL<\/li>\n<\/ol>\n<p>\u00a0<\/p>\n<p>JURISDI\u00c7\u00c3O,<\/p>\n<p>Estes Termos ser\u00e3o regidos e interpretados exclusivamente de acordo com as leis do Brasil. The services that are performed by this app are for use under medical guidance and supervision, therefore you agree that this app does not provide any medical recommendations. The use of services is not a substitute for other health treatments. If you are in an emergency or life-threatening situation, seek medical attention immediately.<\/p>\n<p>\u00a0<\/p>\n<p>It should be noted that this is an application for medical use, not recreational. Therefore, the application does not replace the doctor who prescribed it and who will always be watching the case, including cases of suicidal behavior. THIS APP IS NOT DESIGNED TO REPLACE THE psychiatrist in serious cases with a risk of suicide. It was not designed to be a substitute for the physician IN MEDICAL EMERGENCIES or to PREVENT SUICIDE, but rather as an assistant in the usual care in mental health. That is, it is up to the clinician who prescribed it and not the application to guide the patient about actions in case of any serious suicidal ideation. It is up to the user to seek out his\/her assistant physician and follow his\/her guidance on worsening situations. (MOODR) DOES NOT END YOUR THIRD PARTY SERVICES AND CONTENT AND (MOODR) SHALL NOT BE RESPONSIBLE FOR ANY THIRD PARTY PRODUCT OR SERVICE. In addition, Apple Inc., Google, Inc., and \/ or its international subsidiaries and affiliates will be the third party beneficiaries of this Agreement if you access the Services using applications developed for Apple iOS and Android-based mobile devices, respectively. These third party beneficiaries are not parties to this Agreement and are not responsible for the provision of the Services or for any form of support for the Services. You agree to keep correct, complete and up-to-date information in your Account. You are responsible for all activities performed on your Account and agree to always maintain the security and confidentiality of your Account username and password. Unless otherwise permitted by (Moodr) in writing, you may maintain only one Account.<\/p>\n<p>PROMOTIONAL MESSAGES,<\/p>\n<p>By creating an Account, you agree that the Services may send you informational text messages (Mobile Notifications) and \/ or electronic messages (email) as part of regular business operations for use of the Services. You may choose not to receive text messages and \/ or email from (Moodr) at any time by sending an email to <strong>atendimento@moodr.com.br<\/strong> and indicating that you no longer wish to receive these messages along with the receiving cell phone number and email. You acknowledge that choosing not to receive messages may impact your use of the Services.<\/p>\n<p>\u00a0<\/p>\n<p>ACCESS TO NETWORK AND EQUIPMENT,<\/p>\n<p>You are responsible for obtaining the data network access required to use the Services. Your data and messaging network fees and charges may apply if you access or use the Services from a wireless device and you are responsible for those fees and charges. You are responsible for purchasing and updating the equipment and devices required to access and use the Services and Applications and any updates thereof. A menos que (Moodr) acuerde lo contrario en un contrato escrito directamente con usted, el Servicio estar\u00e1 disponible para su <strong>uso personal y no comercial.<\/strong><\/p>\n<p>Usted comprende y acepta que <strong>este servicio no brinda un asesoramiento m\u00e9dico.<\/strong> Los servicios que realiza este aplicativo son para ser usados bajo supervisi\u00f3n m\u00e9dica, por lo tanto, usted acepta que este aplicativo no proporciona ninguna recomendaci\u00f3n m\u00e9dica. <strong>El uso de los servicios no substituye otros tratamientos de salud<\/strong>. Si se encuentra en una situaci\u00f3n de emergencia o amenaza de vida, busque atenci\u00f3n m\u00e9dica de inmediato.\u00a0\u00a0\u00a0<\/p>\n<p>Cabe se\u00f1alar que esta es una aplicaci\u00f3n para uso m\u00e9dico, no recreativo. Por tanto, la aplicaci\u00f3n no sustituye al m\u00e9dico que la prescribi\u00f3 y que siempre estar\u00e1 pendiente del caso, incluso en los casos de comportamiento suicida. ESTA APLICACI\u00d3N NO EST\u00c1 DISE\u00d1ADA PARA SUSTITUIR AL psiquiatra en casos graves con riesgo de suicidio. No fue dise\u00f1ado para ser un sustituto del m\u00e9dico EN EMERGENCIAS M\u00c9DICAS o para PREVENIR EL SUICIDIO, sino como un asistente en la atenci\u00f3n habitual en salud mental. Es decir, le corresponde al cl\u00ednico que lo prescribi\u00f3 y no a la aplicaci\u00f3n orientar al paciente sobre las acciones en caso de cualquier ideaci\u00f3n suicida grave. Depende del usuario buscar a su m\u00e9dico asistente y seguir sus indicaciones sobre situaciones que empeoran. En cualquier caso, la aplicaci\u00f3n tiene una medida de ideaci\u00f3n suicida en su dise\u00f1o, para el seguimiento por parte del cl\u00ednico, pero no para ser su sustituci\u00f3n en casos urgentes, en los que recomendamos utilizar las formas habituales de manejo de estas situaciones JUNTO CON EL M\u00c9DICO. Moodr no reemplaza al m\u00e9dico que est\u00e1 a cargo de su caso.<\/p>\n<p>LICENCIA<\/p>\n<p>Sujeto al cumplimiento de estos T\u00e9rminos, (Moodr) le otorga una licencia limitada, no exclusiva, no sublicenciada, revocable e intransferible para: (i) acceder y usar los aplicativos en su dispositivo personal, exclusivamente para su uso de los Servicios; y (ii) acceder y usar cualquier contenido, informaci\u00f3n y material relacionado que pueda estar disponible a trav\u00e9s de los Servicios, en cada caso, para su uso personal, nunca comercial. (Moodr) y sus afiliados se reservan todos los derechos que no est\u00e9n expresamente otorgados por estos T\u00e9rminos.<\/p>\n<p>RESTRICCIONES<\/p>\n<p>Usted no podr\u00e1: (i) eliminar ning\u00fan derecho de autor, marca registrada u otro aviso de propiedad de ninguna parte de los Servicios; (ii) reproducir, modificar, preparar trabajos derivados, distribuir, licenciar, arrendar, vender, revender, transferir, mostrar, transmitir, transmitir o, de cualquier otra forma, explotar los Servicios, excepto seg\u00fan lo expresamente permitido por (Moodr); (iii) descompilar, realizar ingenier\u00eda inversa o desensamblar los Servicios, excepto seg\u00fan lo permita la ley aplicable; (iv) conectar, duplicar o cortar cualquier parte de los Servicios; (v) crear o iniciar programas o scripts con el fin de raspar, indexar, buscar o cualquier otra forma de obtener datos de cualquier parte de los Servicios, o para sobrecargar o perjudicar indebidamente la operaci\u00f3n y\/o funcionalidad de cualquier aspecto de los Servicios; o (vi) intentar obtener acceso no autorizado a los Servicios o perjudicar cualquier aspecto de los Servicios o sus sistemas o redes relacionados.<\/p>\n<p>SERVICIOS Y CONTENIDO DE TERCEROS,<\/p>\n<p>Los Servicios podr\u00e1n estar disponibles y se podr\u00e1 acceder a ellos en relaci\u00f3n con los Servicios y el contenido de terceros (incluida la publicidad) que (Moodr) no controlar\u00e1. USTED RECONOCE QUE DIFERENTES T\u00c9RMINOS DE USO Y POL\u00cdTICAS DE PRIVACIDAD PUEDEN APLICARSE AL USO DE ESTOS SERVICIOS Y CONTENIDO DE TERCEROS(AS). (MOODR) NO AVALA ESTOS SERVICIOS Y CONTENIDO DE TERCEROS, Y (MOODR) NO SER\u00c1 RESPONSABLE EN NINGUNA HIP\u00d3TESIS DE NING\u00daN PRODUCTO O SERVICIO DE ESTOS TERCEROS(AS). Adem\u00e1s, Apple Inc., Google, Inc. y\/o sus subsidiarias y filiales internacionales ser\u00e1n terceros beneficiarios de este Acuerdo si accede a los Servicios utilizando aplicativos desarrollados para dispositivos m\u00f3viles basados en Apple iOS y Android, respectivamente. Estos terceros beneficiarios no son partes de este Acuerdo y no son responsables de la prestaci\u00f3n de los Servicios ni de ning\u00fan tipo de soporte para los Servicios. Estos T\u00e9rminos y el uso de los Servicios no le otorgan ni le confieren ning\u00fan derecho: (i) sobre los Servicios, excepto por la licencia limitada otorgada anteriormente; o (ii) de usar o, de alguna manera, referirse a nombres corporativos, logotipos, nombres de productos o servicios, marcas comerciales o marcas de servicio de (Moodr) o cualquier licenciante de (Moodr).<\/p>\n<ol start=\"3\">\n<li>USO DE LOS SERVICIOS<\/li>\n<\/ol>\n<p>\u00a0<\/p>\n<p>CUENTAS DE USUARIOS,<\/p>\n<p>Para usar la mayor\u00eda de los Servicios, debe registrarse y mantener una cuenta de usuario (Cuenta) personal. Debe tener al menos 18 a\u00f1os o la mayor\u00eda de edad requerida por la ley en su jurisdicci\u00f3n (si es diferente de 18 a\u00f1os) para abrir una cuenta. El registro de la cuenta requiere que usted presente a (Moodr) cierta informaci\u00f3n personal, como su nombre, direcci\u00f3n de correo electr\u00f3nico, fecha de nacimiento, sexo y peso. Usted acepta mantener informaci\u00f3n correcta, completa y actualizada en su Cuenta. Usted es responsable de todas las actividades realizadas en su Cuenta y acepta mantener la seguridad y confidencialidad del nombre de usuario y contrase\u00f1a de su Cuenta en todo momento. A menos que (Moodr) lo permita por escrito, solo podr\u00e1 mantener una cuenta.<\/p>\n<p>MENSAJES PROMOCIONALES<\/p>\n<p>Al crear una Cuenta, usted acepta que los Servicios pueden enviarle mensajes de texto informativos (Notificaciones en el m\u00f3vil) y\/o mensajes electr\u00f3nicos (correo electr\u00f3nico) como parte de las operaciones comerciales regulares para usar los Servicios. Puede elegir no recibir mensajes de texto y\/o mensajes electr\u00f3nicos (correos electr\u00f3nicos) de (Moodr) en cualquier momento enviando un correo electr\u00f3nico a <strong>atendimento@moodr.com.br <\/strong>e indicando que ya no desea recibir estos mensajes, junto con el n\u00famero de tel\u00e9fono celular que los recibe y el correo electr\u00f3nico. Usted reconoce que al elegir no recibir mensajes, podr\u00e1 afectar su uso de los Servicios.<\/p>\n<p>ACCESO A LA RED Y AL EQUIPO,<\/p>\n<p>Usted es responsable de obtener el acceso a la red de datos necesario para usar los Servicios. Las tarifas y los cargos por su red de datos y mensajes pueden aplicarse si accede o utiliza los Servicios desde un dispositivo inal\u00e1mbrico y usted es responsable de esas tarifas y cargos. Usted es responsable de comprar y actualizar los equipos y dispositivos necesarios para acceder y usar los Servicios y Aplicativos y cualquier actualizaci\u00f3n de los mismos. (MOODR) NO GARANTIZA QUE LOS SERVICIOS, O CUALQUIER PARTE DE ELLOS, FUNCIONAR\u00c1N EN CUALQUIER EQUIPO O DISPOSITIVO EN PARTICULAR. Adem\u00e1s, los Servicios podr\u00e1n estar sujetos a mal funcionamiento y demoras inherentes al uso de Internet y las comunicaciones electr\u00f3nicas,\u00a0<\/p>\n<ol start=\"4\">\n<li>LIMITACI\u00d3N DE RESPONSABILIDAD,<\/li>\n<\/ol>\n<p>(MOODR) NO SER\u00c1 RESPONSABLE POR DA\u00d1OS INDIRECTOS, INCIDENTALES, ESPECIALES, PUNITIVOS O EMERGENTES, INCLUYENDO GANANCIAS PERDIDAS, P\u00c9RDIDA DE DATOS, DA\u00d1OS MORALES O PATRIMONIALES RELACIONADOS O DERIVADOS DE CUALQUIER USO DE LOS SERVICIOS INCLUSO SI (MOODR) HA SIDO INFORMADO DE LA POSIBILIDAD DE TALES DA\u00d1OS.\u00a0 (MOODR) NO SER\u00c1 RESPONSABLE DE NING\u00daN DA\u00d1O, OBLIGACI\u00d3N O P\u00c9RDIDA DERIVADA DE: (i) SU USO DE LOS SERVICIOS O SU INCAPACIDAD PARA ACCEDER O UTILIZAR LOS SERVICIOS; O (ii) CUALQUIER OPERACI\u00d3N, INCLUSO SI (MOODR) HA SIDO INFORMADO DE LA POSIBILIDAD DE TALES DA\u00d1OS.<\/p>\n<p>LAS LIMITACIONES Y EL DESCARGO DE RESPONSABILIDAD DE GARANT\u00cdAS CONTENIDAS EN ESTA CL\u00c1USULA NO TIENEN EL PROP\u00d3SITO DE LIMITAR LAS RESPONSABILIDADES O DE CAMBIAR LOS DERECHOS DEL CONSUMIDOR QUE, DE ACUERDO CON LA LEY APLICABLE, NO PUEDEN SER LIMITADOS O CAMBIADOS.<\/p>\n<p>INDEMNIZACI\u00d3N,<\/p>\n<p>Usted acepta indemnizar y mantener a (Moodr), sus funcionarios, sus directores, sus empleados y sus agentes exentos de responsabilidad por todos y cada uno de los reclamos, cargos, p\u00e9rdidas, responsabilidades y gastos (incluidos los honorarios) que surjan de o est\u00e9n relacionados con: (i) el uso de los Servicios, servicios o bienes obtenidos a trav\u00e9s del uso de los Servicios; (ii) el incumplimiento o la violaci\u00f3n de cualquier disposici\u00f3n de estos T\u00e9rminos; (iii) el uso, por (Moodr), del Contenido del Usuario (a); o (iv) la violaci\u00f3n de los derechos de terceros, incluidos terceros proveedores.\u00a0<\/p>\n<ol start=\"5\">\n<li>LEGISLACI\u00d3N APLICABLE<\/li>\n<\/ol>\n<p>JURISDICCI\u00d3N<\/p>\n<p>Estos T\u00e9rminos se regir\u00e1n e interpretar\u00e1n exclusivamente de acuerdo con las leyes de Brasil. Usted otorga su aprobaci\u00f3n a (Moodr) para asignar y transferir estos T\u00e9rminos en su totalidad o en parte, incluyendo: (i) a una subsidiaria o afiliada; (ii) a una adquirente de participaciones, negocios o activos de (Moodr);\u00a0 o (iii) a un sucesor debido a cualquier transacci\u00f3n corporativa.
